Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website https://nordsms.es (“NordSMS”), a service owned and operated by WizWorks OÜ, a company registered under Estonian law (Registry Code: 17229942) with its principal office at Harju maakond, Tallinn, Kesklinna linnaosa, Tornimäe tn 5, 10145 (“Company”, “we”, “us”).

By registering for or using NordSMS, you (“User”, “you”) agree to be bound by these Terms and enter into a binding agreement.

1. Service Description

NordSMS offers cloud-based telecommunications, SMS marketing, and information service solutions. Access to certain services requires Know Your Customer (KYC) verification.

2. Eligibility

You must be at least 18 years old and fully capable of entering into binding legal agreements to use this service. Use of NordSMS in connection with any unlawful activity is strictly prohibited.

3. KYC and User Verification

We partner with Authenticate.com, a third-party KYC provider, to verify user identities. By using NordSMS, you agree to the terms of Authenticate.com and consent to the processing of your data, which may occur outside the European Economic Area (EEA). Their privacy policy applies in addition to ours. KYC is mandatory to access critical features of our service.

4. Data Processing and Compliance

All personal data is processed in accordance with the General Data Protection Regulation (GDPR) (EU Regulation 2016/679). By using our service, you consent to:

  • The storage and processing of your personal data,
  • Potential data transfer outside of the EU, especially to Authenticate.com,
  • Our right to store data for compliance and legal obligations.

We take appropriate technical and organizational measures to protect your data.

5. User Responsibility

You are solely responsible for:

  • The accuracy and legality of any information submitted,
  • Your use of the platform,
  • Any consequences arising from your actions.

We disclaim all liability for any fraud, scam, or illegal activity you may perform using our platform. In such cases, we reserve the right to:

  • Suspend or terminate your account,
  • Cooperate with law enforcement,
  • Share all relevant information with judicial authorities.

6. Intellectual Property

All content, code, design, and features of NordSMS are the intellectual property of WizWorks OÜ or its licensors. You may not reproduce, copy, or redistribute content without written consent.

7. Limitation of Liability

We do not guarantee uninterrupted service. We are not liable for damages arising from system outages, data loss, third-party services, or user misconduct.

8. Contractual Agreement

By creating an account and using NordSMS, you:

  • Agree to these Terms,
  • Enter into a legally binding agreement with WizWorks OÜ,
  • Acknowledge having read, understood, and accepted our Privacy Policy and the terms of Authenticate.com.

9. Modifications

We may modify these Terms at any time. Users will be notified of major changes. Continued use of the service implies acceptance of the updated Terms.

10. Jurisdiction

These Terms shall be governed by the laws of Estonia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Tallinn, Estonia.
